Recipients of personal data

Handling of applicant data

We offer you the opportunity to apply to us (e.g. by email, by post or via an online application form). We assure you that your data will be collected, processed and used in accordance with applicable data protection law and all other statutory provisions and that your data will be treated in strict confidence.

Scope and purpose of data collection

If you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes taken during interviews, etc.) insofar as this is necessary to decide on the establishment of an employment relationship. The legal basis for this is Section 26 of the German Federal Data Protection Act (BDSG) (initiation of an employment relationship), Art. 6(1)(b) GDPR (general initiation of a contract) and, if you have given your consent, Art. 6(1)(a) GDPR. Consent can be withdrawn at any time. Within our company, your personal data will only be passed on to persons involved in processing your application.

If your application is successful, the data you have submitted will be stored in our data processing systems on the basis of Section 26 BDSG and Art. 6(1)(b) GDPR for the purpose of carrying out the employment relationship.

Data retention period

If we are unable to offer you a position, you decline a job offer or you withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6(1)(f) GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. The retention serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the 6-month period has expired (e.g. due to an impending or pending legal dispute), it will only be deleted once the purpose for the further retention no longer applies.

Data may also be retained for longer if you have given your consent (Art. 6(1)(a) GDPR) or if statutory retention obligations prevent its deletion.

5. Newsletter

Subscription to our newsletter

The website of QUBUS Planung und Beratung Oberflächentechnik GmbH gives users the opportunity to subscribe to our company's newsletter. The personal data transmitted to the controller when ordering the newsletter is determined by the input form used for this purpose.

QUBUS Planung und Beratung Oberflächentechnik GmbH informs its customers and business partners about the company's offers and news by means of a newsletter. The data subject can in principle only receive our company's newsletter if (1) the data subject has a valid email address and (2) the data subject has consented to receiving the newsletter. Registration for the newsletter is possible via a registration form of the service provider rapidmail. For legal reasons, a confirmation email is sent using the double opt-in procedure to the email address first entered by a data subject for the newsletter. This confirmation email serves to verify whether the owner of the email address, as the data subject, has authorised the receipt of the newsletter. The registration only becomes effective once it has been confirmed via the link contained in the email.

When you register for the newsletter, we also store the IP address of the computer system used by the data subject at the time of registration, as assigned by the internet service provider (ISP), as well as the date and time of registration. The collection of this data is necessary in order to be able to trace any misuse of an email address at a later date and therefore serves the legal protection of the controller.

We use the service provider rapidmail, operated by Positive Group Deutschland GmbH, Wentzingerstraße 21, 79106 Freiburg im Breisgau, Germany, to send and manage our newsletter. The personal data collected as part of the newsletter registration is transmitted to rapidmail and processed on behalf of QUBUS Planung und Beratung Oberflächentechnik GmbH for sending and managing the newsletter. The processing is based on the consent given under Art. 6(1)(a) GDPR and, where applicable, on a data processing agreement under Art. 28 GDPR.

The personal data collected when registering for the newsletter is used to send our newsletter and to evaluate and optimise the newsletter dispatch. Newsletter subscribers may also be informed by email if this is necessary for the operation of the newsletter service or a related registration, as might be the case with changes to the newsletter offer or changes to the technical circumstances.

The data subject can cancel the subscription to our newsletter at any time. Consent to the processing of personal data for sending the newsletter and the associated evaluation can be withdrawn at any time with effect for the future. For the purpose of withdrawing consent, each newsletter contains a corresponding link. It is also possible to notify the controller of this by other means. Newsletter tracking

The newsletters of QUBUS Planung und Beratung Oberflächentechnik GmbH contain so-called tracking pixels and, where applicable, individually marked links. A tracking pixel is a miniature graphic embedded in emails sent in HTML format to enable log file recording and analysis. This allows a statistical evaluation of the success or failure of online marketing campaigns.

Based on the embedded tracking pixel, QUBUS Planung und Beratung Oberflächentechnik GmbH can recognise whether and when an email was opened by a data subject. The individually marked links make it possible to trace whether and which links in the email were accessed by the data subject. The personal data collected via the tracking pixels and links contained in the newsletters is stored and evaluated by the controller in order to optimise the newsletter dispatch and to better tailor the content of future newsletters to the interests of the data subjects. This data is processed on the basis of the consent given by the data subject under Art. 6(1)(a) GDPR.

We use the service provider rapidmail to carry out and evaluate the newsletter tracking. The data collected as part of the tracking is transmitted to rapidmail and processed on behalf of QUBUS Planung und Beratung Oberflächentechnik GmbH. The data is not passed on to any other third parties.

Data subjects are entitled to withdraw their consent to the processing of the tracking data at any time with effect for the future. The withdrawal can be made via the unsubscribe link contained in every newsletter or by other means to the controller. Unsubscribing from the newsletter is automatically treated as a withdrawal of consent to newsletter tracking.
